Terms of Service

1. Acceptance of the Terms

By accessing or using HyperTrader (hereinafter "the Service", available at https://hypertrader.ca), you agree to be bound by these Terms of Service ("Terms"). If you do not accept these Terms, you must not use the Service.

The Service is operated by Groupe Expert (Québec, Canada). For any question: support@hypertrader.ca.

2. Description of the Service

HyperTrader is an information and simulation service based on public HyperLiquid data. The Service offers:

• Trader card rental: monthly access, for the duration of the rental, to the signals (publicly executed orders) of selected, on-chain-verifiable HyperLiquid traders — copied in SIM mode, with a Telegram or Discord alert for each copied trade. Access ends with the rental.
• SIM mode (simulation): simulated performance tracking based on the traders' real trades, with virtual Credits allocated by the user. No real money.
• HyperTrader Executor app (APP mode): software offered as an invite-only beta, that you install and run locally on your own device, which can automatically replicate the rented signals on your HyperLiquid account, according to the settings you configure (risk, coins, limits, kill-switch). Non-custodial: see section 6.
• Leaderboards, rankings, and educational content.

HyperTrader is not a broker, a financial advisor, a custodian, an exchange, or a regulated financial services provider. We do not hold your funds, we do not execute any order for you, and we do not operate any smart contract that receives user deposits.

3. Eligibility and registration

• You must be at least 18 years old.
• You must provide a valid, unique email address.
• You are responsible for keeping your credentials confidential and for any activity performed through your account.
• The Service is not available to residents of the United States, Iran, North Korea, Russia, Syria, Cuba, and other jurisdictions under international sanctions.

4. No performance guarantee — Risk warning

• Traders' past performance does not guarantee future performance.
• Leverage (up to 40×) amplifies gains and losses.
• Traders are human — their win rates, R:R and drawdowns are variable.
• Copy trading mirrors a third party's decisions; HyperTrader does not influence, direct, or validate those decisions.
• You should never invest more than you can afford to lose.

5. User responsibility

You acknowledge and agree that:

• You are solely responsible for all your trading decisions and their financial consequences.
• Renting a card gives access to the trader's signals for the rented period. Whether you execute a signal manually or enable automated copying through the local app, activating, configuring (risk, coins, limits, kill-switch) and maintaining that copy is exclusively your informed decision.
• You have performed your own due diligence (research, understanding of the risks) before any action involving real money.
• You comply with the tax and regulatory laws of your country of residence.

6. Custody of funds

HyperTrader never holds, controls, or touches your funds.

• We hold no private key, no seed phrase, no user HyperLiquid account.
• We operate no smart contract that receives or manages user funds.
• If you choose to execute the signals manually on your own HyperLiquid account, this happens through your personal wallet (MetaMask or other), without any intervention from HyperTrader.
• The HyperTrader Executor app (APP mode) runs locally on your device: the HyperLiquid API key you enter into it is stored on your machine and is never transmitted to our servers. Orders go from your device directly to HyperLiquid. You are responsible for the security of the device the app runs on.

7. Fees and commissions

HyperTrader only charges:

• The monthly rental of trader cards, per card (SIM-mode copy and Telegram or Discord alerts included; the app as an invite-only beta), at the price shown in the shop at the time of order, based on the trader's tier.
• The optional monthly all-access plans (every trader), at the price shown in the shop.
• An annual option may be offered (equivalent to free months compared to monthly billing), as shown in the shop.

Any rental is cancellable at any time; access stays active until the end of the period already paid, with no renewal. No performance fee is charged.

All payments are in Canadian dollars via Stripe. HyperTrader takes no commission on the trades you execute on your own HyperLiquid account.

If you trade on HyperLiquid, HL trading fees, funding rates, and taxes applicable in your jurisdiction are your exclusive responsibility.

8. Limitation of liability

To the fullest extent permitted by applicable law:

• The Service is provided "as is" without warranty of any kind, express or implied.
• HyperTrader, Groupe Expert (Québec, Canada), its officers, employees, and affiliates shall in no event be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including without limitation: loss of profits, loss of data, loss of capital, service interruption.
• HyperTrader's total liability to you, for any cause of action, is limited to the amount you actually paid to HyperTrader over the last 12 months, or USD $100, whichever is greater.

8b. Accuracy of displayed data

The statistics displayed on trader cards (P&L, WR, orders, green coins, grades, etc.) are computed from public HyperLiquid data. Despite an automatic cross-check process and a verification pipeline (execution-data hash, scan timestamp, triple-green check), errors or inaccuracies are possible (API pagination, missing data, FIFO computation bugs, timezone offsets, etc.).

By accepting these Terms, you acknowledge that HyperTrader is not liable for erroneous or inaccurate figures displayed on the cards or in the leaderboards.

Every card includes a "View on HL" link that opens the trader's public HyperLiquid page — you can always cross-check yourself before any decision.

If you spot an error, contact us at support@hypertrader.ca. Our commitment: fix within 48 h after verification on our side (indicative, best-effort timeframe).

9. Indemnification

You agree to defend, indemnify and hold harmless HyperTrader, Groupe Expert (Québec, Canada) and its affiliates from any claim, damage, obligation, loss, liability, cost or debt, and expense (including reasonable attorney fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party right.

10. Changes to the Service and the Terms

We reserve the right to modify or discontinue all or part of the Service at any time, with or without notice. We may update these Terms; substantial changes will be notified by email. Continued use of the Service after notification constitutes acceptance.

11. Termination

You may terminate your account at any time. We may suspend or terminate your access immediately, without notice, if you violate these Terms or if we deem it necessary to protect the Service or other users.

12. Governing law and jurisdiction

These Terms are governed by the laws of the province of Quebec, Canada, and applicable Canadian federal laws.

Any dispute will first be submitted to an attempt at amicable resolution. Failing that, the dispute will be submitted to arbitration under the rules of the ADR Institute of Canada (Quebec), in Montreal. The parties waive any class action.

13. Miscellaneous

• Entire agreement: these Terms constitute the entire agreement between you and HyperTrader.
• Severability: if a clause is held invalid, the remaining clauses stay in force.
• Assignment: you may not assign these Terms. We may assign them freely.
